HIPAA Alert: Updated Guidance from HHS Re: Disclosure of COVID-19 Status to First Responders

Today the Office for Civil Rights (OCR) at the Department of Health and Human Services (HHS) issued guidance on the disclosure of the COVID-19 status of a patient to law enforcement, paramedics, other first responders and public health authorities.

In the guidance, the OCR recognizes that due to the current national public health emergency, first responders need access to real time infection information to both treat their patients and protect themselves. As such, the guidance clarifies that institutions may disclose PHI without a patient’s authorization in those circumstances. However, the OCR reminds practitioners and institutions that they must make reasonable efforts to limit the information disclosed to the “minimum necessary” to accomplish the purpose of the disclosure.

Cook County Health Foundation Christopher Cahill is Executive Editor of the recently released Commercial Bankruptcy Litigation, 2d Edition (Jonathan P. Friedland, Elizabeth Vandesteeg & Christopher M. Cahill eds., 2020). This treatise is comprehensive and annually updated. Chris has served as in this capacity since 2014. The book is available for purchase here.

Chris and Lars Peterson are co-authors of the treatise’s Chapter 7, on asset sales in bankruptcy, entitled “Litigation Concerning the Use, Sale, or Lease of Estate Property Other Than Cash Collateral.”

Health Care / Medical Malpractice Paralegal and Corporate Paralegal

Our L&G Law Group LLP (formerly Lowis & Gellen LLP) Chicago office is in search of a paralegal who has obtained at least three years of legal experience in Medical Malpractice/Healthcare and Corporate matters such experience with large complex commercial litigation, including cases filed in federal court.   The firm is also considering filling this position with two separate paralegals–one with Medical Malpractice/Healthcare experience and the other with the above-mentioned Corporate experience.

The ideal candidate will have a strong Medical Malpractice/Healthcare and/or Corporate background.  We value excellent organizational and problem solving skills, the ability to craft creative strategies for our clients and the ability to take initiative.  Excellent writing, interpersonal, and communication skills are required.
